COMMENTS CONCERNING HISTORICAL MONUMENTS

Section 1:  This past week, one of our Brothers in the Department of North Carolina posted on social media under our organization’s name text that was in violation of General Order #27 Series 2019-2020, 16 June 2020 and General Order No. 02 Series 2017-2018, 21 August 2017. On the same day of this post, our Brother was advised of the violation and quickly removed his post.

Section 2:  In paragraph 1 of General Order #27, Commander-in-Chief Ed Norris states that “Due to the current political climate the Sons of Union Veterans of the Civil War has seen an increase in the number of requests for comment concerning historical monuments.”
              
Section 3:  The Department Secretary/Treasurer and Camp Secretaries had forwarded last week to our Brothers of our Department General Order #27 Series 2019-2020, 16 August 2020 prior to the social media post mentioned in Section 1 above. However, in order to be sure all Brothers in our Department see the content of Commander-in-Chief Ed Norris’ General Order #27, it reads as follows:

“1. Due to the current political climate the Sons of Union Veterans of the Civil War has seen an increase in the number of requests for comment concerning historical monuments.”
“2. I want to remind our Brothers of two documents which should be reviewed.
a.    Past Commander-in-Chief Mark R. Day’s General Order No. 2, Series 2017-2018
b.    Battle Flag and Monument Policy (August 2017)”

Section 4: In order to be sure all Brothers in our Department see the content of Past Commander-in-Chief Mark Day’s General Order No. 02 Series 2017-2018, 21 August 2017, it reads as follows:

“1. I hereby direct, with the concurrence of the members of the Council of Administration, that all departments, camps, and individual brothers refrain from acting as a Media spokesmen or agent for the Sons of Union Veterans of the Civil War or to become involved in the pursuit of any civil actions (legal proceedings), on behalf of the Sons of Union Veterans of the Civil War, regarding the removal of veteran’s monuments, without first contacting the Commander-in-Chief and receiving authorization from him.”
“a. Acting as a spokesman is defined as making statements written or oral using the organizations name, symbols, letterhead, or while in the branded attire of the organization to include SVR uniforms and symbols.”
“b. This Order in no way is intended to preclude the exercise of your rights as an individual outside of the SUVCW.”
“2. The Commander-in-Chief will serve as the primary point of contact on all media inquiries involving the removal of veteran’s monuments. Media outlets should be directed to forward their inquiries to the SUVCW National Headquarters at 1 Lincoln Circle at Reservoir Park, Suite 240, Harrisburg, PA 17103-2411 Telephone: (717) 232-7000 Fax: (717) 412-7492.”

Section 5: As mentioned in the above Orders, they do not intend to preclude the exercise of our Brothers rights as an individual outside of the SUVCW. However, as stated in the Orders, there should be no communications about monuments under the name of the SUVCW without authorization of the Commander-in-Chief, and all Media inquiries should be referred to our National Organization as specified in the Orders.

Section 6: Please be sure that all our Brothers in the Department of North Carolina, Sons of Union Veterans of the Civil War are familiar with and comply with Commander-in-Chief Ed Norris’ General Order #27 Series 2019-2020, 16 June 2020 and Past Commander-in-Chief Mark Day’s General Order No. 02, 21 August 2017.

OBSERVANCE OF FLAG DAY

Section 1:  In the United States, Flag Day is celebrated on June 14 and commemorates the adoption of the flag of the United States on June 14, 1777 by resolution of the Second Continental Congress. The United States Army also celebrates the U.S. Army birthday on this date, since Congress adopted “the American continental army” after reaching a consensus position in the Committee of the Whole on June 14, 1775.

Section 2:  In 1916, President Woodrow Wilson issued a proclamation that officially established June 14 as Flag Day, and on August 3, 1949, National flag Day was established by an Act of Congress under Title 36 of the United States Code, Subtitle I, Part A, Chapter 1, Section 110.
              
Section 3:  Following the Civil War, the men who fought under the flag of the United States knew of the great sacrifices that had been made to preserve the Union, and they wanted others, particularly students, to know about the flag and what it means to each of us. As Sons of Union Veterans of the Civil War, we have a responsibility to educate others about the flag of the United States and the proper respect it deserves.

Section 4: As members of the Sons of Union Veterans of the Civil War, please remember Flag Day by flying the American flag at your home and encourage others to fly the flag at their homes and businesses.

Section 5: As members of Sons of Union Veterans of the Civil War, additional things you can do to honor, recognize and celebrate the use of the American flag are:
·        Award Certificates of Commendation in recognition of exemplary Patriotism in the display of the Flag of the United of America, and this Certificate form can be purchased from the National Quartermaster.
·        Print and/or download the Flag Facts Flyers from our National website and distribute them to students and in such places as schools, libraries and history museums.
·        Camps can offer to perform Dignified Flag Disposal Ceremonies by using the written ceremony provided on our National website.

OBSERVANCE OF MEMORIAL DAY

Section 1:  Memorial Day was borne out of the Civil War and a desire to honor our dead. It was officially proclaimed on 5 May 1868 by General John Logan, National Commander of the Grand Army of the Republic, in his General Order No. 11 and was first observed on 30 May 1868, when flowers were placed on the graves of Union and Confederate soldiers at Arlington National Cemetery.

Section 2:  On June 28, 1968, Congress passed the Uniform Monday Holiday Act, which moved Memorial Day to the last Monday in May and is May 25 this year. This Act did not change our sacred obligation to remember and honor the memory of our Nation’s defenders.
              
Section 3:  One of the Missions of the Sons of Union Veterans of the Civil War is to cooperate with others in honoring all who have patriotically served our country in any war. Our Order participates in a variety of ceremonies designed to honor Union veterans of the Civil War and veterans of all U.S. conflicts, and the most important of these is Memorial Day.

Section 4: As members of the Sons of Union Veterans of the Civil War, please remember and honor our Union dead by participating in a Memorial Day Ceremony. If you’re unable to attend a group Ceremony, then please attend to the grave of a Union veteran by flagging it or placing a flower there to honor and remember him.

Section 5: During this time of the Coronavirus Pandemic, please follow the guidelines of the Center for Disease Control by wearing a mask, maintaining a distance of six feet from one another and wash your hands properly and frequently in order to protect yourself and your Brothers and the public from this highly contagious virus.

It was the Department’s first electronic encampment conducted using Zoom due to the ongoing Coronavirus Pandemic. 2018 SUVCW NATIONAL ENCAMPMENT & AWARDS

The 137th National Encampment of the Sons of Union Veterans was held August 9-12, 2018 in Framingham, Massachusetts. Donald W. Shaw, PDC, Department of Michigan, was elected Commander-in-Chief of our Order. The Department of North Carolina congratulates Commander-in-Chief Shaw on his election, and we thank Past Commander-in-Chief Mark R. Day for his service to our Order as Commander-in-Chief.

I want to thank Department of NC Brothers James Johnson, and Henry Duquette for attending the National Encampment as members of the Department of NC Delegation. Their attendance and participation at the Encampment are greatly appreciated.

National Award #1: The Department of North Carolina was the recipient of The Under Forty Award. This award is presented to the Department with the greatest number of new members under age forty (40) during the period 1 April through 31 March. The award is presented by the Commander-in-Chief based upon the information provided within the annual reports received by the National Executive Director no later than 31 May. The award is a certificate signed by Commander-in-Chief Mark R. Day.

National Award #2: The Department of North Carolina was also the recipient of The U.S. Grant Cup. This award is presented to the Department with the greatest percentage increase in membership during the period 1 April through 31 March. The award is presented by the Commander-in-Chief based upon the information provided within the annual reports received by the National Executive Director no later than 31 May. The award is a streamer for the Department of NC flag, and the departments name will also be inscribed on the permanent plaque at National Headquarters.

Also nominated for a National Award, and worthy of special recognition: The Department of NC Website (The Horace Greeley Award for most outstanding department website), and the George Stoneman Camp #6 (The Joseph S. Rippey Award for most outstanding new Camp). Brother James Johnson serves as Department Signals Officer & Webmaster, and Brother Robert Crum serves as Stoneman Camp #6 Camp Commander & Organizer.

PROPOSED AMENDMENTS TO THE BY-LAWS OF THE DEPARTMENT OF NORTH CAROLINA, SUVCW TO BE OFFERED AT THE 5 MAY 2018
11th ENCAMPMENT IN MOREHEAD CITY, NORTH CAROLINA

That the Department enact new Articles XII, XIII, XIV, in accordance with the directive of General Order #18, Series 2017-2018 as follows:


ARTICLE XII
ORGANIZATION


Section 1. The Department shall be constituted and remain constituted as provided by the Constitution and Regulations (C&R) governing the National Organization, Sons of Union Veterans of the Civil War, and shall be known as the DEPARTMENT OF NORTH CAROLINA, SONS OF UNION VETERANS OF THE CIVIL WAR.  The Department is organized as an unincorporated association under the laws of the State of North Carolina. The organization is organized exclusively for charitable, religious, educational, and scientific purposes under section 501(c)3 of the Internal Revenue Code, or corresponding section of any future tax code

ARTICLE XIII
ACTIVITIES NOT IN FURTHERANCE OF EXEMPT PURPOSES

Section 1. No part of the net earnings, if any, of this unincorporated association, shall inure to the benefit of, or be distributable to its members, trustees, officers or other private persons, except that the unincorporated association shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purposes described in section 501(c)3.  No substantial part of the activities of the unincorporated association shall be the carrying on of propaganda, or otherwise attempting to influence legislation, and the unincorporated association shall not participate in, or intervene in (including the publishing or distribution of statements) any political campaign on behalf of or in opposition to any candidate for public office.  Notwithstanding any other provision of these by-laws, the unincorporated association shall not carry on any other activities not permitted to be carried on (a) by an unincorporated association exempt from federal income tax under section 501(c)3 of the Internal Revenue Code, or the corresponding section of any future federal tax code, or (b) by an unincorporated association, contributions to which are deductible under section 170(c)2 of the Internal Revenue Code, or the corresponding section of any future federal tax code. 

ARTICLE XIV
SEPARATION, DISSOLUTION AND DISPOTITION OF ASSETS
            
Section 1. In the case of surrender or forfeiture of the Department Charter, all Department property and assets shall be turned over to the National Commander-in-Chief of the Sons of Union Veterans of the Civil War via the Department Commander of the affected Department acting as his duly authorized representative to collect and hold all such property in trust for the National Organization, Sons of Union Veterans of the Civil War, an organization exempt from taxes under section 501(c)3 of the Internal Revenue Code. 

Section 2. All property of the Department shall be held for the National Organization, Sons of Union Veterans of the Civil War, as a charitable trust that is held and used for the purpose for which the Order exists.  Any such transfer or disposal within six months of disbandment or surrender of the Department Charter without the written consent of the National Commander-in-Chief of the Sons of Union Veterans of the Civil War is prohibited. The property and funds of the Department shall not be divided among its members. 

Section 3. In the event the National Organization, Sons of Union Veterans of the Civil War, no longer exists, said property and funds shall revert to the benefit of the first and any remaining organization of the Allied Orders of the Grand Army of the Republic or in their absence, to the State archives of North Carolina. 

Section 4. Notwithstanding the above language, upon the dissolution of this organization, assets shall be distributed for one or more exempt purposes within the meaning of section 501(c)3 of the Internal Revenue Code, or corresponding section of any future federal tax code, or shall be distributed to the federal government, or to a state or local government for a public purpose.

That the Department enact a new Article XV, in accordance with the directive of General Order #11, Series 2016-2017 as follows:

ARTICLE XV
MINORS

Section 1. The Department of North Carolina and all subordinate Camps shall remain in full compliance with General Order 22, Series 2013-2014; the National Policy Regarding Minors adopted by the Council of Administration 11 July 2014, plus any subsequent policy, General Order, and/or Regulation of the Order regarding minor’s participation in any and all activities of the Order occurring within the Department.
